General Terms and Conditions (GTC) for ReportingToGo

1. Scope

These General Terms and Conditions (GTC) apply to all contracts regarding the use of the "ReportingToGo" platform between Medianest GmbH (hereinafter "Provider") and entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB) (hereinafter "Customer").

3. Subject Matter of the Contract

ReportingToGo is a cloud-native web application that enables marketing managers to upload campaign screenshots, automatically read them with GoogleGemini (Vertex AI), and evaluate them in real time. Starting in Q4/2025, payment transactions (self-service subscriptions) will be processed entirely via Stripe Payments (PCI-DSS Level 1). Stripe webhooks run via Cloud Run in the same GCP region; subscription events are persisted in the Firestore collection users/$uid/billing. Use is provided "as is" – particularly depending on the availability of these third-party infrastructures.

4. Registration and Conclusion of Contract

Use requires registration. By submitting the registration form, the customer submits a binding offer. The contract is concluded upon activation of the user account by the provider.

5. Trial Phase and Usage

After registration, the customer is granted a free trial phase. After the trial period ends, the account is converted into a paid plan if actively selected by the customer. Usage can be canceled monthly.

6. Prices and Billing

Billing is done per user account via the payment service provider Stripe. All prices are net plus statutory VAT. Invoices are made available for download in the customer account.

7. Payment Default

In case of payment default, the affected customer account will be suspended. The payment obligation remains unaffected.

8. Support

Support inquiries are initially answered automatically via an integrated chatbot. If no solution is found, support is available by email at support@reportingtogo.de.

9. Availability

The tool is based on third-party infrastructure (especially OpenAI, Vercel, MongoDB Atlas, Stripe, Cloudinary, SendGrid). The provider does not guarantee uninterrupted availability but strives for the best possible accessibility according to the capabilities of this infrastructure.

10. Usage Rights

The customer receives a simple, non-transferable right of use for the duration of the contract. Redistribution, sublicensing, or any other use beyond the purpose of the contract is prohibited.

12. Liability

The provider is only liable for intent and gross negligence. Liability for outages or incorrect processing by third-party services (e.g., OpenAI, Stripe, Vercel, etc.) is excluded to the extent permitted by law.

13. Contract Duration and Termination

The contract is concluded for an indefinite period and can be terminated by either party with effect at the end of the month. Termination is carried out in the customer account or via email.

14. Jurisdiction and Applicable Law

German law applies. The place of jurisdiction for all disputes is Hannover.

15. Changes to these GTC

The provider reserves the right to change these GTC with effect for the future. Changes will be communicated to the customer in text form. If the customer does not object within 14 days, the changes shall be deemed accepted.
